COOKIE POLICY

This page describes the methods and purposes of the processing, carried out through cookies, of the personal data of users (hereinafter referred to as “Users” or “Data Subjects”) who visit the website www.nunziantemagrone.it (the “Website”).

For additional information regarding other processing of personal data carried out on the Website, please view the Website’s Privacy Policy at the following link Privacy Policy.

  1. Contact Details of the Data Controller
The Data Controller is Nunziante Magrone Studio Legale Associato, VAT No.: 06080161000, with registered office in Rome, Piazza di Pietra 26, tel. +3906695181, e-mail roma@nmlex.it (the “Data Controller” or also the “Firm”).
  1. What Are Cookies

2.1 Cookies are small text files that websites visited by the User automatically send to the User’s device (usually to the browser), where they are stored and later transmitted back to the same websites. They are generally used for different purposes, such as: performing digital authentication, monitoring sessions, storing specific user configuration information, saving preferences, etc.2.2 Depending on the website and the domain that installs the cookies, they can be categorised as follows:

  1. First-party cookies: installed on the user’s device directly by the Data Controller or operator of the website being visited by the User;
  2. Third-party cookies: installed through the website that the User is accessing by Data Controllers or by different web servers.

2.3 Depending on their duration, cookies can be classified as follows:

  1. Session cookies: temporarily stored in the User’s device until the browser session ends. Such cookies are generally necessary to ensure the proper functioning of the website’s applications and features;
  2. Persistent cookies: remain stored on the User device for a longer period than a single browsing session, depending on their function and on the User’s preferences. Persistent cookies allow information to be transmitted back to the web server each subsequent time the website is accessed.

2.4 Based on their purpose, cookies can be grouped into two macro-categories:

  1. Technical cookies, which, being strictly necessary to provide the service requested by the User, do not require the User’s consent. Without them, certain operations may not be carried out or may be more complex and/or less secure. For this reason, they are automatically installed when the User accesses the website. They include: (i) Navigation cookies, which ensure normal browsing and use of the website (for example, to make a purchase or log in to secure areas), (ii) Functionality cookies, which allow Users to browse the website according to selected criteria, such as their preferred language);
  2. Profiling cookies, which are used to associate specific actions or recurring behavioural patterns in the use of the services offered with specific, identified, or identifiable individuals for the purpose of grouping different profiles into homogeneous clusters of varying sizes. This makes it possible for the Data Controller to, among other things, customise the delivery of services in an increasingly personalised manner beyond what is strictly necessary for the provision of the services, as well as to send targeted advertising messages, in line with preferences expressed by Users while browsing. This category also includes so-called “social cookies”, those put in place by social networks and used in accordance with the relevant social network’s policies, as well as so-called “analytics cookies”, which are used to analyse access and visits to the website itself and allow the Data Controller to improve its structure, browsing logic, and content and to assess the effectiveness of provided services, measure “traffic” (or rather the number of visitors, also possibly categorised according to geographical area, connection time, and other characteristics), unless they can be treated as technical cookies, which is only possible if (i) the use of the analytics cookies is limited to the production of aggregated statistics and they are used for a single website or a single mobile app so as to prevent tracking the browsing history of an individual who uses different apps or visits different websites, (ii) they are created and used directly by the first-party site or, if used by a third-party, suitable tools are adopted to reduce identifiability (by masking significant portions of the IP address), and (iii) there are contractual conditions between websites and third parties, which specifically refer to third-party commitments or to using them exclusively for the purpose of providing a service, storing them separately, and not “enriching them” or “cross-referencing them” with other information already in possession, nor disclosing them to additional third parties. As profiling cookies are not strictly necessary for the functioning of the website, their installation requires User’s consent.
  1. Cookies Used on the Firm’s Website
3.1 The Website uses the following technical cookies which, as they are strictly necessary, cannot be disabled through the “Manage Preferences” tool. For each technical cookie listed, the specific function, duration, and source are provided.3.2 The Website also uses the following profiling cookies, specifically third-party analytics cookies.
The Firm has no control over the processes used by third-party websites to collect information about Users’ browsing activities, associated with the personal data already in their possession. We invite you, therefore, to view the privacy policies of the third parties, the links to which are provided in the table below, in order to learn about the purposes for which data is collected, including for advertising. These policies should also allow you to make your selections regarding consent directly with the relevant third parties through the mechanisms made available by them. For each cookie listed in the table below, the specific function, duration, and whether it is first-party or third-party source is specified. A link to the relevant website’s privacy policy and consent form is also provided, where it is possible to review and modify preferences.Analytics Cookies:
  1. Consent to the Use of Cookies

4.1 When first accessing any page on the Website, a banner is displayed containing a brief privacy notice with a link to this Cookie Policy, an “Accept” button, which the User can click to consent to the installation of all cookies other than technical cookies, and a “Manage cookies” button which allows the User, through a dedicated tool, to give (or subsequently withdraw) consent, either to all cookies or, separately, to the various functions, third parties, and categories of non-technical cookies by moving the relative cursors. It is not possible to disable technical cookies, as they are strictly necessary for the functioning of the Website. In the top right corner of the banner, there will also be a button marked with an X. Selecting this retains the default settings, under which no non-technical cookies will be installed, and, therefore, browsing will continue without any cookies other than technical cookies.4.2 Closing the banner by clicking on the X in its top right corner, scrolling down the page, or clicking on any part of the page outside the banner does not constitute consent to the use of cookies other than technical cookies.

4.3 The User may at any time access the “Manage Cookies” tool to withdraw or modify previously given consent by clicking on the button present in the footer of any page of the Website.

4.4 The Firm uses technical cookies to store the User’s cookie preferences.

4.5 Through the options provided by the browser, it is always possible to configure the browser so that cookies are either stored on the device or rejected, for example based on a default setting or on their respective owners. Each browser manages cookie preferences differently, as described in the help pages of each browser. Cookies can be disabled by following the instructions provided by the main browsers at the following links:
Please note that if the User chooses to disable also technical cookies through the functions provided directly by the browser, many of the Website’s functions may be lost and some services may not operate as they should.

4.6 Additional information is available at http://www.youronlinechoices.com/it/le-tue-scelte/, which brings digital advertising professionals together in the European Digital Advertising Alliance, EDAA. The companies involved in this alliance allow Users, through this website, to reject or accept the cookies they use to tailor ads that may be displayed on their device to the information linked to their browsing behaviour.

  1. Purposes and Legal Basis of the Processing of Personal Data

5.1 Data collected through technical cookies will be processed for the purposes described in section 2.4(a), with the functions described in the table in section 3.1, exclusively to allow the User to correctly use all the functions of the Website and the requested services; therefore, on the legal basis of the execution of a pre-contractual request or the execution of a contract.5.2 Data collected through profiling cookies is used for the purposes described above in section 2.4(b), with the functions described in the tables in section 3.2, only when the User has given consent, which constitutes the legal basis for such processing.

  1. The Nature of Data Provision

6.1 Technical cookies are necessary to allow the User to take advantage of the Website’s functions and services; therefore, they are not subject to prior consent and cannot be disabled.6.2 On the other hand, profiling cookies are not strictly necessary for use the Website and their installation is subject to the User’s consent. Failure to provide consent to this type of cookies will not prevent browsing or use of the Website.

  1. Processing Methods
Users’ personal data is processed using electronic and IT tools for the time strictly necessary to achieve the purposes for which it was collected. It is processed in compliance with applicable legislation, adopting appropriate and adequate security measures designed to prevent unauthorised access, disclosure, alteration, or unauthorised destruction.
  1. Recipients of the Data

8.1 Users’ personal data will be processed by employees or collaborators of the Firm, duly trained in data processing, or other data processors (such as companies providing assistance/services, consulting, data processing, and other IT services), as well as, on the basis of User consent, third parties listed in the table under item 3 above.8.2 Users’ personal data may also be disclosed to other third parties where legally required and/or pursuant to a binding judicial or administrative decision.

  1. Data Retention Period
Cookies are stored in the User’s device for the duration indicated in the tables in sections 3.1 and 3.2 above.
  1. User Rights

10.1 As a Data Subject, you have rights with regard to the Data Controller, provided for under Articles 12 et seq. of EU Regulation 679/2016 (the “GDPR”), including the right to access personal data. You may therefore, among other things, obtain confirmation as to whether or not your personal data has been processed. You also have the right to request, in accordance with the law, the rectification or erasure of data, or the restriction of its processing, in view of the protection of your rights and the processing of your data, and to object to its processing, as well as to withdraw consent given through the “Manage cookies” tool referred to in section 4.3 above. You also have the right to have the data you provided released, in electronic format, to you or to another party designated by you.10.2 You may exercise these rights by sending a request to the following e-mail address: roma@nmlex.it

10.3 You also have the right to lodge a complaint with the Italian Data Protection Authority (www.garanteprivacy) if you believe that the processing of your personal data violates applicable legislation.

  1. Changes to this Policy
It may occasionally be necessary to modify this policy due to changes in legislation or to keep up with technological developments. The Firm reserves the right to make such changes, which will be communicated via a pop-up banner when accessing the Website or through other suitable means.
